Rearp: Senado pode votar nesta terça-feira, o Regime Especial de Atualização e Regularização Patrimonial
Brasília — O Plenário do Senado pode votar nesta terça-feira (18) a proposta que cria o Regime Especial de Atualização e Regularização Patrimonial (Rearp). O substitutivo da Câmara ao Projeto de Lei 458/2021, autoriza a atualização do valor de imóveis e veículos no Imposto de Renda e a regularização de bens lícitos não declarados.
Apresentado pelo então senador Roberto Rocha (MA), o texto já foi aprovado na Câmara — com alterações — e incorporou medidas fiscais que originalmente estavam previstas em uma medida provisória (a MP do IOF) que perdeu a validade em outubro.
Para pessoas físicas, o substitutivo prevê que a atualização acarretará cobrança de 4% sobre a diferença entre o valor declarado e o valor de mercado, em substituição ao Imposto sobre Ganho de Capital, que varia de 15% a 22,5%. Para pessoas jurídicas, as alíquotas serão de 4,8% de IRPJ e 3,2% de CSLL.
De acordo com a proposta, o valor atualizado passa a valer como novo custo de aquisição em vendas futuras.
Quanto à regularização, o texto prevê: multa de 100% do imposto devido; redução do prazo de adesão de 210 para 90 dias; e parcelamento máximo de 24 meses.
O substitutivo também reduz o período mínimo de manutenção dos bens atualizados e permite a atualização de patrimônio localizado no exterior.
Medida Provisória do IOF
A Câmara incorporou ao substitutivo dispositivos que estavam previstos em uma medida provisória: a chamada MP do IOF (MP 1.303/2025).
Entres a medidas, foram incluídos no substitutivo restrições a compensações tributárias, a revisão de regras do Programa Pé-de-Meia, o ajuste no prazo do auxílio-doença por análise documental (Atestmed) e limites à compensação previdenciária entre regimes.
O impacto fiscal estimado dessas medidas é de cerca de R$ 19 bilhões.
